These terms apply to all visitors, users, and others who access or use any Diverge platform, product, or service, including but not limited to DivergeGPT, TawtheefAI, MawjazAI, DivergeInsight, DivergeVerse, DivergeTwin, and WaveAI.

Diverge provides artificial intelligence solutions including Computer Vision, Generative AI (Large Language Models), and Metaverse services. Our AI products are designed to assist users by generating content, performing analysis, automating tasks, and providing insights based on available data.

You may use our services only for lawful purposes and in accordance with these terms. You agree not to use our services in any way that violates applicable local, national, or international laws or regulations, or to exploit, harm, or attempt to exploit or harm any person or system.

We reserve the right to restrict or terminate your access to any of our services at our sole discretion if we believe you are in violation of these terms.

The outputs generated by our AI products, including text, analysis, recommendations, reports, and any other content, are provided on an "as is" basis. While we strive to deliver high-quality and useful results, we do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated output for any particular purpose.

AI-generated content is not a substitute for professional advice, including but not limited to legal, financial, medical, or technical advice. You should independently verify any AI-generated output before making decisions or taking actions based on it. Diverge shall not be held responsible for any decisions made or actions taken based on the outputs of our AI systems.

Our AI systems may produce results that are incomplete, inaccurate, or biased. Users are solely responsible for evaluating the appropriateness and accuracy of any output before use.

All intellectual property rights in and to the Diverge website, platforms, AI models, software, algorithms, designs, trademarks, logos, and all related content are owned exclusively by DivergAI or its licensors. Nothing in these terms grants you any right, title, or interest in our intellectual property except as expressly stated.

You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on our technology, products, or services without prior written consent from DivergAI.

As a user of our services, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account or using our services.

You must not use our AI products to generate harmful, misleading, defamatory, or illegal content. You must not attempt to bypass any security measures, abuse system resources, or interfere with the proper functioning of our platforms.

You are solely responsible for ensuring that your use of our services complies with all applicable laws and regulations in your jurisdiction.

To the maximum extent permitted by applicable law, DivergAI and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use our services.

In no event shall the total liability of DivergAI exceed the amount you have paid to DivergAI, if any, for access to or use of the services during the twelve months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

We may suspend or terminate your access to our services at any time, with or without cause or notice, at our sole discretion. Upon termination, your right to use our services will immediately cease.

All provisions of these terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.

These Terms of Service shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Abu Dhabi, UAE.

If any provision of these terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
